ATF National Response Team Activated to Investigate Montezuma, Ga. Warehouse Fire

/PRNewswire/ -- The Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) National Response Team, along with ATF special agents from the Atlanta Field Division, have entered the investigation of a commercial warehouse fire that occurred on February 12, 2010, in Montezuma, Georgia. The NRT is deploying at the request of the Georgia State Fire Marshal's Office.

The facility, an approximately 120,000 square-foot building, located at 261 Hamilton Road in Montezuma, is the former site of Evergreen Composite Technologies a composite wood manufacturing plant. No deaths or injuries were reported, yet the building was completely destroyed.

ATF's NRT has brought definitive expertise and an array of state-of-the-art equipment to the investigation of major fire and explosives incidents since 1978. Four regional components, organized geographically to cover the United States, comprise the NRT. The team can respond within 24 hours to assist state and local law enforcement or fire service personnel in onsite investigations.

The responding NRT component normally has 18 members, including veteran special agents who have post-blast and fire origin-and-cause expertise; forensic chemists; explosives enforcement officers; fire protection engineers; accelerant detection canines; explosives detection canines; and intelligence, computer forensic and audit support. A fleet of fully equipped response vehicles strategically located throughout the United States provides logistical support. The responding NRT team supervisor is Supervisory Special Agent Chris Porreca stationed in Jacksonville, Fla. and the Team Special Agent in Charge is Dondi Albritton, stationed in Louisville, KY.

ATF's partnership with federal, state and local officers is vital to the most effective processing efforts at an explosives or fire scene. The NRT capitalizes on that by working alongside its partners in reconstructing the scene, identifying the seat of the blast or the origin of the fire, conducting interviews and sifting through debris to obtain evidence related to the explosion or fire.

In addition to investigating hundreds of large fire and explosives scenes, the NRT trucks were deployed for the 2001 terrorist attack on the Pentagon; the Olympics and other major sporting events in the United States; presidential inaugurations and the national political conventions; and major international conferences.

This is the 11th activation of the NRT in FY 2010 and the 693nd since its inception in 1978.

Georgia seeks to revoke license of company for pesticide misuse

The Georgia Department of Agriculture will be seeking to revoke the structural pest control license of Biotech Systems of Georgia (Biotech) due to the misapplications of pesticides. Biotech is a Pelham, Alabama, company that treats nursing homes and other healthcare facilities in Georgia and several other states.

The Agriculture Department is alerting 154 facilities serviced by Biotech about possible pesticide misapplications. The Department has also notified the Environmental Protection Agency, the Georgia Department of Human Resources and appropriate regulatory agencies in other states.

The action follows an investigation that began last month. During a routine inspection on May 5, 2009, the Department of Agriculture found information that indicated pesticides were misapplied by Biotech at two Georgia nursing homes.

The Georgia Agriculture Department asked for records from Biotech and received an incomplete set of pesticide use records from the company on May 20. On June 9, at the request of the Agriculture Department, the Georgia Structural Pest Control Commission (GSPCC) ordered Biotech to produce a complete set of pesticide use records and have the records delivered to the Department by June 17. (GSPCC has authority under the Georgia Structural Pest Control Act to compel the production of documents.)

Records furnished by Biotech indicate that pesticides were misapplied to numerous facilities.

Some of the pesticide application records delivered to the Georgia Agriculture Department by Biotech on June 17 are different from the records obtained on May 20. “This concerns us greatly. At least some of the records appear to conflict with the records we obtained earlier and are therefore possibly suspect,” said Deputy Commissioner of Agriculture Terry Coleman.

Of greatest concern are the misapplications of the pesticides Termidor and ZP Tracking Powder. The Georgia Agriculture Department tested eight nursing homes and found Termidor present in all eight. It appears that Termidor, an insecticide labeled for use outdoors, was used indoors, and ZP Tracking Powder, a rodenticide, was improperly used in a food storage area. The Department is sending clean-up recommendations to the facilities as provided by the manufacturers of these pesticides.

“We have also notified the Georgia Health Care Association. Its staff is working to make sure safety concerns are addressed,” said Deputy Commissioner Coleman.

“We will seek to revoke the license of Biotech Systems of Georgia because the company appears to have disregarded rules governing pesticide application on numerous occasions. These rules are not arbitrary but are based on the effective use of these pesticides and, what is more important, on concerns of safety for people and the environment,” said Coleman.

The NRT is deploying at the request of the Athens-Clarke County Fire Department and will arrive this morning to begin its work at the scene.

The structure, a popular entertainment venue located at 215 North Lumpkin Street in Athens, suffered extensive damage with a preliminary estimated loss of $1.5 to $2 million.

Georgia DNR Charges 7 with 113 Counts in South Ga. Poaching Investigation

Georgia Department of Natural Resources officers charged seven people with a total of 113 poaching-related counts in Dodge and Laurens counties this week.

The investigation sparked by complaints and started in March resulted in search warrants served at the Rentz home of Michael Warren and a home and cabin owned by William Stacy Jones of Eastman on May 18. Evidence seized varied from computers to animal parts, said Sgt. Keith Byers of the DNR’s Wildlife Resources Division. The counts range from hunting deer at night to possession of illegally taken wildlife, hunting out of season and taking over the bag limit. Most involved deer or turkeys.

“In my 28 years (with the division), I’ve never seen anything like this,” Byers said of the amount of evidence and scope of violations.

Those charged were William Stacy Jones, 31, of Eastman (70 charges); Mary Michelle Warren, 28, of Eastman (17 charges); Michael Warren, 30, of Rentz (nine charges); Cody Coleman, 21, of Marietta (six charges); Durwood “Trey” Graham III, 29, of Eastman (four charges); Summer Page, 28, of Rentz (four charges); and, Brandon Brisco, 31, of Eastman (three charges).

Each misdemeanor count carries a maximum penalty of up to a $1,000 fine and up to a year in jail. Other charges are possible. Most were filed in Dodge County. Michael Warren faces five counts in Laurens County.

Byers said complaints about the suspects increased in February. An investigation was opened in March. Two months later, Cpl. Johnny Ashe and Rangers 1st Class Rodney Horne and Barry Britt served search warrants at the homes of William Stacy Jones and Michael Warren, leading to the arrests and the array of charges.

Byers explained that such investigations take time. Rangers spent hours working the case, sorting evidence and making charges. “When looking at evidence you have to basically connect the dots that lead you back to a suspect,” Byers said. “In this case, there were a lot of dots to connect.”

Bonds for the suspects range from $1,500 to $15,000.

FBI to Assist FDA in Ongoing Investigation of the Peanut Corporation of America‏

Special Agent in Charge (SAC) Gregory Jones, FBI Atlanta, announces the FBI’s assistance to the Food and Drug Administration, Office of Criminal Investigations (FDA/OCI), in the ongoing investigation of the Peanut Corporation of America.

The FBI was asked to assist FDA/OCI in this matter, due to its ability to bring to bear a considerable amount of investigative resources. Although the FBI is fully involved in this investigation, FDA/OCI remains the lead federal investigative agency. As such, the FBI will defer to FDA/OCI for all public commentary regarding the details of this ongoing investigation.

For the time being, the FBI will make no further public comment on this matter.

ATF National Response Team Activated to Georgia Mill Fire

PRNewswire-USNewswire/ -- The National Response Team (NRT) from the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) along with ATF special agents from the Columbus Satellite Office and the Macon Field Office, of the Atlanta Field Division, have entered into the investigation of a large commercial fire at the request of the Columbus Department of Fire and Emergency Medical Services. The fire occurred Thursday, Oct. 30, at the Bibb Mill located at 3715 First Ave., downtown Columbus. The NRT arrived today and will begin its work at the scene.

The 750,000 square foot structure was built around 1920 and holds significant historical value to the community. The approximate loss is estimated at $2 million. The Mill housed several businesses and a portion of the property was to be converted to a condominium community. There are no reported injuries at this time and the investigation is continuing.

In 1978, ATF developed the NRT to provide resources to federal, state and local investigators in meeting the challenges faced at the scenes of significant arson and explosives incidents. The NRT consists of four teams organized geographically to cover the United States. Each team can respond within 24 hours to assist state and local law enforcement/fire service personnel in onsite investigations.

In addition to investigating hundreds of large fire scenes, the NRT has also been activated to scenes such as the 1993 World Trade Center bombing, the Oklahoma City Federal Building bombing and the 9/11 Pentagon crash site, as well as explosions at explosives and ammunition manufacturing plants, legal fireworks factories and illegal explosive device manufacturing operations.

The teams are each composed of veteran special agents who have post blast and fire origin-and-cause expertise; forensic chemists; explosives enforcement officers; fire protection engineers; accelerant detection canines; explosives detection canines; intelligence support, computer forensic support and audit support. The teams work alongside state and local officers in reconstructing the scene, identifying the seat of the blast or origin of the fire, conducting interviews, and sifting through debris to obtain evidence related to the bombing/arson.

Further complementing the team's efforts are technical, legal and intelligence advisors. Moreover, a fleet of fully equipped response vehicles strategically located throughout the United States is available to provide logistical support.

This will be the NRT's second activation in fiscal year 2009 and the 660th activation since the inception of the NRT in 1978.

FDA Issues Interim Safety and Risk Assessment of Melamine and Melamine-related Compounds in Food

The U.S. Food and Drug Administration (FDA) today issued the results of its interim safety and risk assessment of melamine and melamine-related compounds in food, including infant formula.

A safety/risk assessment is a scientifically based methodology used to estimate the risk to human health from exposure to specified compounds. It is based on available data and certain scientific assumptions in the absence of data. The purpose of the FDA interim safety/risk assessment was to identify the level of melamine and melamine-related compounds in food which would not raise public health concerns. The interim safety/risk assessment evaluated the melamine exposure in infant formula and in other foods.

The safety/risk assessment, prompted by reports of melamine contamination of milk-derived ingredients and finished food products containing milk manufactured in China, was conducted by scientists from FDA's Center for Food Safety and Applied Nutrition and the Center for Veterinary Medicine. The FDA reviewed scientific literature on melamine toxicity.

Infant Formula

FDA is currently unable to establish any level of melamine and melamine-related compounds in infant formula that does not raise public health concerns. In large part, this is because of gaps in our scientific knowledge about the toxicity of melamine and its analogues in infants, including:

1. the consequences of the continuous use of infant formulas as the sole source of nutrition;
2. the uncertainties associated with the possible presence and co-ingestion of more than one melamine analogue; and
3. for premature infants with immature kidney function, the possibility that they may be fed these formulas as the sole source of nutrition and thus on a body weight basis experience greater levels of intake for a longer time than is experienced by term infants.

There is too much uncertainty to set a level in infant formula and rule out any public health concern. However, it is important to understand that this does not mean that any exposure to any detectable level of melamine and melamine–related compounds in formula will result in harm to infants.

Other Food Products

In food products other than infant formula, the FDA concludes that levels of melamine and melamine-related compounds below 2.5 parts per million (ppm) do not raise concerns. This conclusion assumes a worst case exposure scenario in which 50% of the diet is contaminated at this level, and applies a 10-fold safety factor to the Tolerable Daily Intake (TDI) to account for any uncertainties. The TDI is an estimate of the maximum amount of an agent to which an individual could be exposed on a daily basis over the course of a lifetime without an appreciable health risk.

FDA continues to screen products, collaborate with foreign governments and their regulatory agencies, and monitor reports of contamination from international sources to help ensure that potentially contaminated products from foreign sources are examined if imported into the United States. If products are adulterated because they contain melamine and/or a melamine-related compound, the agency will take appropriate actions to prevent the products from entering commerce.

Two Men Sentenced for Making False Bomb Threat to CDC

QUANTAVIOUS GREENE, 28, of Jackson, Georgia, and ELIJAH CHANDLER, 21, of College Park, were sentenced today (July 16, 2008) by United States District Judge Orinda D. Evans on charges of aiding and abetting one another in using the telephone to call in a false bomb threat to the Atlanta-based Centers for Disease Control (CDC) and later making false statements to FBI agents regarding the call.

United States Attorney David E. Nahmias said of the case, “Bomb threats, whether real or false, cause untold costs to the community in terms of law enforcement response, lost working hours, and fear. Anyone who may be inclined to make a bomb threat on a whim should understand that we take those threats very seriously no matter the motivation. One of these defendants wanted to get off work early. Now he and his codefendant are going to federal prison.”

GREENE was sentenced to 4 months in federal prison to be followed by 3 years of supervised release. GREENE pleaded guilty to the charges on November 15, 2007. CHANDLER was sentenced to 6 months in federal prison to be followed by 3 years of supervised release. CHANDLER pleaded guilty to the charges on January 25, 2008.

According to United States Attorney Nahmias and the information presented in court: On April 14, 2006, the CDC Office in Atlanta received a telephone call from a blocked telephone number. The caller stated that a bomb had been placed in the building and identified himself using the name of a former employee of the CDC who had been fired. DeKalb County Police responded and searched the building, but did not find any explosive devices. On the date the call was made, ELIJAH CHANDLER was employed by the CDC as a contract worker. Through a lengthy investigation, FBI agents determined that the former employee whose name was given by the caller did not make the call. Ultimately, the investigation led to GREENE and CHANDLER, both of whom at first gave false statements to the agents about their knowledge of the telephone call and telephone number used. The false statements further impeded the investigation. GREENE later confessed to making the call, stating that CHANDLER urged him to do so so that CHANDLER could leave work early.

This case was investigated by Special Agents of the Federal Bureau of Investigation.

Assistant United States Attorney Katherine Monahan Hoffer prosecuted the case.

FDA Lifts Warning About Eating Certain Types of Tomatoes

The U.S. Food and Drug Administration is updating its warning to consumers nationwide concerning the outbreak of Salmonella Saintpaul.

After a lengthy investigation, the FDA has determined that fresh tomatoes now available in the domestic market are not associated with the current outbreak. As a result, the agency is removing its June 7 warning against eating certain types of red raw tomatoes.

The FDA, working with officials from the Centers for Disease Control and Prevention and state and local health departments, is continuing to follow epidemiological and other evidence showing that raw jalapeño and raw serrano peppers now available in the domestic market may be linked to illnesses in this outbreak. At this time, people in high risk populations, such as elderly persons, infants and people with impaired immune systems, should avoid eating raw jalapeño and raw serrano peppers.

According to the CDC, 1,220 persons infected with Salmonella Saintpaul with the same genetic fingerprint have been identified in 42 states, the District of Columbia and Canada.

Update on NTSB Investigation Involving Midwest Airlines Airplane Carrying Senator Obama

The following is an update on the National Transportation Safety Board's investigation of the incident involving the Midwest Airlines MD-81 airplane carrying Senator Barack Obama on July 7, 2008, in which the tail cone evacuation slide deployed in-flight.

Preliminary findings reveal that the slide was partially inflated and the inflation bottle was empty. Examination of the hardware did not reveal any evidence of missing components, nor any evidence of tampering.

The slide and hardware were removed from the aircraft for examination. There was no evidence of any punctures in the slide; however, there were marks consistent with rubbing of
elevator control cables. Additional evidence was found to indicate that a catwalk railing was broken and impinged upon elevator control cables. The slide and hardware will be sent
to the manufacturer for detailed examinations supervised by the NTSB.

The flight recorders have been removed and are en route to NTSB headquarters for download and analysis. Flight crew statements indicate that the crew did not hear the slide deploy in flight nor did a mechanic who was seated in the rear of the airplane. The flight crew confirmed that they detected elevator control stiffness during the initial level off after departure from Chicago Midway Airport. Maintenance records have been secured for further examination.

Research has been initiated into the certification of the slide, its service history, and its design interface with the airplane.

The NTSB completed the on scene phase of the investigation yesterday.
